EU's Chat Control Law: A Threat to Encryption and an Opening for Web3?

The European Union is closing in on a decision about the Chat Control bill, one of the most controversial proposals touching digital privacy. The bill requires platforms to scan private messages for illegal content before encryption — effectively creating a backdoor in the security system. Privacy Violation Concerns

Experts warn that the legislation could conflict with Articles 7 and 8 of the EU Charter of Fundamental Rights, which protect the confidentiality of communications and personal data rights. Scanning messages on users' devices before they're sent — even absent any sign of wrongdoing — has raised widespread concerns about mass surveillance.

Hans Rempel, CEO of Diode, called this a "dangerous overreach," arguing there's no guarantee the tool won't be abused or that data won't leak, especially given that even government systems regularly suffer security incidents.

Web3 Emerges as an Alternative

Against this backdrop, many experts believe the Chat Control law will erode trust in traditional messaging apps, potentially pushing users toward decentralized platforms in the Web3 ecosystem. There, data is protected "by design," under the familiar mantra: "Not your keys, not your data."

Elisenda Fabrega, legal counsel at Brickken, emphasized that "privacy-conscious users will increasingly turn to Web3 as an alternative."

Germany Holds the Deciding Vote

Currently, 15 EU member states have expressed support for the bill, but that still falls short of the 65% population threshold required for passage. Germany — Europe's largest economy — holds the pivotal role. If Germany votes in favor, the law will almost certainly pass. If Germany opposes or abstains, the bill will fail.

The Future of Digital Privacy in the EU

Even though passage is considered "unlikely," experts say this won't be the last attempt to curtail privacy under the banner of safety. And if that day comes, Web3 may become a refuge for users who want to reclaim control over their own data.
